Some states do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the state and federal courts located in Pennsylvania for any disputes arising out of or relating to these Terms.

Changes to Terms:
We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be posted on our Site, and your continued use of our Site after such changes have been posted constitutes your acceptance of the modified Terms.

 

The following terms and conditions apply to Dyota’s price matching policy:

1. The competitor’s jewelry item must have the same characteristics, including gemstone type, carat weight, color, clarity, cut, and certification, as the Dyota jewelry item. Dyota reserves the right to determine, in its sole discretion, whether the competitor’s jewelry item is comparable.
2. Dyota Lab Created Diamonds are not eligible for the price matching policy as they’re one of a kind.
3. Dyota’s price matching policy cannot be combined with any other offer, promotion, or discount.
4. The price matching policy applies only to certified loose diamonds and Moissanite sold through the Dyota website. We will match full jewelry prices if they’re the same/very similar (gemstone type, carat weight, color, clarity, cut, metal, etc)
5. The price matching policy only applies before you purchase your Dyota jewelry item. Once you purchase from Dyota, if you are not satisfied with your purchase, you can return your item to us within 30 days.
6. To verify the competing price, you must supply our Customer Support team with: (1) a copy of the grading report or certification from the competitor for the same jewelry item, and (2) a link to a website offer or a published price offer from the competitor. (3) a link to our item being compared. (4) your contact info (name, email, phone #)
7. The competing price must be available to any member of the public and cannot be a unique discount.
8. The lower price must remain in effect at the time your request is verified by Dyota.
9. Expired offers, time-limited sales events, clearance, liquidation and going-out-of-business sales, and loyalty program offers are not eligible for the price matching policy.
10. The price matching policy does not apply where the competitor or Dyota has made a pricing error or typographical error on an item.
11. Pawn shops and auctions (websites or brick and mortar stores) are ineligible for the price matching policy.
12. The price matching policy only applies to purchases for personal use. The price matching policy does not apply to purchases for resale or commercial purposes.
13. If Dyota determines that a competitor’s offer meets all of the terms and conditions of our price matching policy, we will honor the new price for 72 hours, and as many quantities as you like.
14. Dyota reserves the right to verify all information regarding the competing offer and to refuse to offer a lower price, in its sole discretion, if unsatisfied with its ability to verify the competing price.
15. Dyota reserves the right to modify or terminate the price matching policy at any time.

By using our price matching policy, you acknowledge and agree to these terms and conditions. Dyota reserves the right to decline any price match request that does not meet these terms and conditions
